Effective September 8, 2026, certain goods imported into Canada and originating in the U.S. are subject to a surtax of either 15%, 25% or 50% of the value for duty, as applicable, in accordance with the United States Surtax Order (2026). The value for duty is determined in accordance with sections 47 to 55 of the Customs Act. The Schedules to the United States Surtax Order (2026) contain a complete list of goods subject to the surtax and the applicable surtax rate.
- The surtax will only apply to goods that originate in the U.S., which shall be considered as those goods eligible to be marked as goods of the U.S. in accordance with the Determination of Country of Origin for the Purpose of Marking Goods
(CUSMA Countries) Regulations. The surtax does not apply to goods eligible to be marked as originating from Puerto Rico, Guam, the Northern Mariana Islands, American Samoa or the U.S. Virgin Islands.

The surtax will apply to goods imported for commercial and casual purposes, even when exported from a country other than the U.S. into Canada.
- Goods classified under Chapters 98 and 99 are exempted from the surtax, unless the applicable Chapter 98 or 99 tariff item is specifically listed in Schedule 4 to the Order. This exemption applies even where the goods' otherwise applicable tariff classification is listed in Schedule 1, 2 or 3
What This Means for You

All duties, taxes, and customs fees are the responsibility of the customer and are collected by U.S. Customs upon delivery.

Brooklyn Clothing Co. does not collect or control these fees, and therefore cannot refund or reimburse any charges applied by U.S. Customs.

While we continue to cover the cost of shipping from Canada, we cannot absorb additional government-imposed tariffs.

All products made in North America are exempt from these U.S. tariffs under the CUSMA trade agreement between Canada, Mexico, and the USA.

Shipping times may vary due to customs processing and delays beyond our control.

Brooklyn Clothing provides all required customs documentation with every international shipment, including HS codes and country-of-origin information, to help ensure your order moves through customs as smoothly as possible.
Please note that duties, taxes, brokerage fees, and other import charges are not included in your order total at checkout. For the most accurate information regarding potential charges, we recommend contacting your local customs office before placing your order.
If a shipment is refused due to unpaid duties, taxes, or other import charges and is returned to Brooklyn Clothing, the order will be subject to a 25% restocking fee. Any original shipping charges paid at the time of purchase are non-refundable.
